Apart from laying down the objectives and scope of the audit the audit plan will need to provide for time planning, (based upon a quantification of necessary audit tasks), the criteria for choosing transactions and items for audit scrutiny, the audit methodology to be followed, (involving procedures for checking of vouchers and postings, carrying out reconciliations of bank and supplier accounts, taking physical stock of inventory items, and checking accounts receivables and payable balances with the external parties), the required audit tests, and the allocation of manpower resources. The establishment of materiality is significant in the formulation of a plan. A proper understanding of the business will help in identifying matters of significance and will enable the plan to incorporate materiality factors vis-a-vis nature, amount and significance of transactions. Identification of areas where controls and checks are loose, as elaborated in task 1, will throw up the possibility of r isks and frauds. These areas will warrant more detailed and intensive scrutiny, as well as the need for overall and input/output checks. Formulation and execution of appropriate audit tests are integral to the successful execution of an audit. While audit tests are mainly framed in accordance with established accounting and auditing procedures they need to be adapted to the nature of the industry and provide for the peculiarities of the business. In the subject case the company uses standard SAGE accounting software, which eliminates to a great degree the need to check for manual accuracy and the correctness of posting entries and arithmetical accuracy of generated accounts. However, errors and irregularities can arise in many other areas and a number of audit tests will need to be included in the required audit methodology. Audit tests should start with a sample checking of the accounting correctness of vouchers to ensure that correct accounts have been debited and credited for both revenue and capital transactions. A sample testing procedure involving complete checking of three months vouchers and varying percentage checks for the other nine months should serve the purpose adequately. Journal vouchers need to be checked to test whether proper accounting procedures have been followed for incorporating extraordinary entries or corrections. Audit tests should include checking of purchases for rates accepted, with those available in the market, tallying of purchase orders, goods inward notes and bills, both for value and quantity, as well as reconciliation of inventory, checking of book and actual balances, sales bills for billing accuracy, both for rates and quantities, sales and collection totals. Apart from these tests, bank and supplier reconciliations, and carrying out of ratio analyses for operating and profit margins, debt and liquidity, will help in providing the auditors with an idea of the financial condition of the company. The following statement outlines the details of work to be carried out and its manner of recording for incorporation in the audit report. The scope of the audit will cover work involved in ascertaining whether the prepared accounts reveal a true and fair picture of the operations of the company for the specified period, the financial condition of the company at the end of the period, and whether financial management practices are appropriate for the efficient and effective running of the company’s operations. Audit activity will include assessing the scope of audit, checking of accounts for accuracy and adherence to stipulated accounting requirements and the appropriate financial framework, through standard auditing procedures involving sample and complete checking, carrying out of audit tests, interviewing and questioning required company officials, use of reconciliations, and other analytical tools like input/output studies, ratios and trends. Daniel Defoes Robinson Crusoe - The First Fiction :: Defoe Robinson Crusoe Essays

Robinson Crusoe: The First Fiction Daniel Defoe is credited with writing the first long fiction novel in literary history. Drawing from established literary genres such as the guide and providence traditions and the spiritual biography, Defoe endeavored to illustrate the life of a man who "tempted Providence to his ruine (Defoe 13)" and the consequences of such actions. While stranded alone on an island the character of Robinson Crusoe seems to have a religious epiphany about the role of Providence in his life and resolves to live in accordance with God's will. However, Crusoe's internal reflections throughout his narrative and his actions do not correlate, causing the reader to question the validity of this conversion. By examining the plot and the process of psychological change Crusoe undergoes, it becomes apparent that "he experiences and accepts divine control but that control can only be realized in the free context he has himself created (359)." When push comes to shove, Crusoe reverts to human instinct and his own impulses rather than what he perceives to be the will of Providence. Crusoe uses his newfound religion only when convenient and as a means to justify his actions and an acceptable reason for everything unfortunate that happens. When he finally does leave the island and returns to society, Crusoe's faith is tested and fails miserably, with practically no mention of Providence towards the end of the story. At the beginning of the novel, Crusoe introduces himself and establishes that his narrative is a memoir of sorts, and is told while looking through more experienced, wise eyes than when he originally experienced his story. This is important to note, because his discourse is shaded with hindsight and interpreted through a mind that has come to accept Providence's hand in his life. For example, when the Turks capture Crusoe and he is enslaved, he reflects by saying, "now the Hand of Heaven had overtaken me, and I was undone without Redemption. But alas! This was but a Taste of th e Misery I was to go thro' (15)." Because Crusoe is recalling the events from memory, as well as the lack of input from any other characters, his reliability can be questioned as a narrator. An unreliable narrator is one who may be in error in his or her understanding or report of things and who thus leaves readers without the guides needed for making judgements.

“One Flew Over the Cuckoo’s Nest” by Ken Kesey Essay

Throughout history, the struggle of women to gain and sustain power in society has proven to be difficult, and has coexisted with a rivalry against the opposite sex. Women have been denied many throughout the course of history. They have been discriminated against, lost jobs, lost privileges. Women’s suffrage had not developed in the United States until the Nineteenth Amendment, which became effective in time to allow the voting by women nationally in the Presidential election of August 18, 1920. Stereotypical views of the ideal features of women are femininity, maternity, gentility, care, nurture, and dependency. Not matriarchy, independence, nor strength. Women are not generally associated with these traits, and society generally expects women to posses the assumed feminine characteristics. This is not the case in the novel One Flew Over the Cuckoos Nest, in which Ken Kesey shows a woman can hold a dominating, powerful role in society and be contrary to the stereotypical woman figure to depict the validity of the society’s views about women and their roles using the failure of the matriarchal female character to succeed at her role assumed by her occupation. The matriarchal female, Mildred Big Nurse Ratched, gains control over her realm in the mental hospital, but fails to fulfill her duties as a nurse of healing or helping her patients. The sexist description of her physical appearance provided by her patients are those typically associated with women, however, she completely contradicts the typical female. She is a matriarchal figure, not maternal. She is powerful, not dependent. And she manipulates complete power over the staff and patients of the hospital. However, her matriarchy does not fulfill her duties assumed by her occupation; to heal and help the patients. Instead, she worsens the situation by diminishing their strengths and exposing their weaknesses; which she does to gain control in a way which appeals to her senses. Big Nurse, or Mildred Ratched, attempts, and succeeds, to create her own world within the confines of the ward; one where she is completely in charge of all her subjects. This depicts her strong matriarchal role. Her desire to gain complete control over her environment uses several strategical moves.  After convincing her patients to confess their personal secrets, Ratched is understood by the patients to use the disadvantages of her patients to her own advantage in her accomplishment of gaining absolute power. Nurse Ratched is able to â€Å"smell out† the fear of her patients and â€Å"put it to use† (17) As the novel progresses, we also learn that Ratched’s powers within the ward extend to ludicrous measures as she is able to order harming of the relatively disruptive patients, which contributes to her extensive amount of power withing the ward. In numerous important scenes, we learn the extent of her power to prevent noisome independence: she can, in additio n to all the little arts of prodding the guilty recesses of her â€Å"patients'† consciences, order electric shock, even lobotomize the recalcitrant or merely disruptive patient. (Boardman ) She achieves control over the ward, as her patients, aware of her power, obey willingly or unwillingly. Mac, a patient at the hospital, promises to bug the nurse â€Å"till she comes apart at those neat little seams† (12). However, he learns that he can be institutionalized as long as the nurse sees fit. He immediately becomes cagey, satisfying, temporarily at least (Boardman)Nurse Ratched is able to establish complete control in the ward, and her patients recognize her ability maintain total control; a type of control that is parallel to a monarchy. In her own realm, Ratched is viewed as a very powerful individual, and the patients start to abide by her rules. Harding, a patient, explains, â€Å"‘We are victims of a matriarchy here, my friend, and the doctor is just as helpless against it as we are'† (54). This sentence is remarkably significant. It accredits the nurse as a dominant character in the hospital, and it also establishes the idea that the patients are not the only ones controlled by her, but the doctors as well. At times, Ratched refers to the sexuality of the men in the institute, making them inferior because of their inabilities. Ratched’s strength, and matriarchial character as a woman directly contradict the assumed characteristics associated with women; those of femininity and gentility. This contradiction is established in a way many by critics that look at the surface of the topic as a sexist description. In multiple occurrences throughout the progression of the novel, Ratched’s female characteristics are exaggeratively described by the patients such as McMurphy. McMurphy describes Ratched as having too red lipstick and the too  big boobs. (43) and as a a bitch and a buzzard and a ballcutter. Therefore, Ratched directly opposes the traditional gentle view of women as a matriarch but is given over-exaggerated female characteristics. Kesey’s purpose in creating this contrast between a stereotypical woman and and an ideal woman that is independent and strong is to establish the unsuccessful attempt at triumph of the ideal strong woman. The unsuccessful attempts of Ratched are depicted by her failure to meet the assumed role of being a nurse that consists of helping and healing her patients. Instead of helping, Ratched proceeds to make the state and situation of her patients worse and worse as she puts them down about their inabilities and maintains total control over them. Ratched is even viewed as evil. McMurphy explains, No, that nurse ain’t some kinda monster chicken, buddy, what she is is a ball-cutter. I’ve seen a thousand of ’em, old and young, men and women. Seen ’em all over the country and in the homes–people who try to make you weak so that they can get you to toe the line, to follow their rules, to live like they want you to. †¦ If you’re up against a guy who wants to win by making you weaker instead of making himself stronger, then watch for his knee, he’s gonna go for your vitals. And that’s what that old buzzard is doing. (58) McMurphy also refers to Ratched as impregnable and this sets her apart from the typical view of a female and the clichà ©d mother/whore dichotomy (Quinn) is established in the novel. There is an ambiguity that arises in the course of the novel, and the established dichotomy discussed by Quinn is expanded with a comparison of the two parts; the matriarch and the whore. Whereas Ratched uses power and control to accomplish her role of care and fails, the two whores introduced by McMurphy gain the trust and sympathy of the reader. They are viewed positively and as kind hearted by the patients in the institution. An excellent comparison captures the perception of the two figures; Strong women are evil and emasculating (Quinn) and The women viewed positively in the novel are the kind-hearted whores whom Mac introduces to the men and the sympathetic and very tiny Japanese nurse who works on the Disturbed ward. (Quinn) Through this direct comparison of the strong woman that is apart from a typical figure and the stereotypical woman that performers an act  directly associated with women, one can see that the typical woman is able to do what the other cannot; gain the affection of the male. While Ratched hides her female characteristics by wearing a white coat, the whores display their female attributes, and gain a positive view from the society made up of the hospital. McMurphy’s prior comment of Ratched being impregnable is linked to this comparison, since sexuality is a trait apparently missing from Ratched. Ken Kesey depicts the failure of a non-typical female figure to accomplish her goals as a dominating powerful figure by describing Ratched as evil, and comparing her to whores, who are viewed as kind hearted. This defiant comparison is uncommon since typically whores are viewed as a malignant part of society and nurses are viewed as purgatory. As a complete opposite, the whores are able to help amend the feelings of the patients, whereas Nurse Ratched fails miserably to accomplish her duty and even worsens the situation of her patients. Through the development of the female characters in the novel One Flew Over the Cuckoos Nest, Kesey is able to convince the reader that the stereotypical woman is able to successfully help society, while the unusual matriarchal female is unable to fulfill her duties by gaining control and exercising domination. Provide Displays in Schools Essay

1.1 Describe the school policy for displays Our school policy for displays is quite dated and maybe updated soon. It describes why we have displays in school and how this impacts on the children. There is a section on organising and actively involving children in the displayed work. We have no rules on backing or mounting. It is left to whoever is doing the display to pick and choose their colours and mounts. We are asked to take care as to how we secure items on the display (we don’t like drawing pins) and to keep in the restraints of finance. Different class are allocated different areas of the school for their displays. We can put up wall displays, table top and shelve displays. We can make mobiles to display work. 1.2 Describe the importance and purposes of displays in schools. Displaying pupils work is a powerful way of showing them that their work is valued. It creates a sense of achievement. It can very much boost pupil motivation. They should praise effort as well as perfect work. It should be that there is a piece of work by every child on display somewhere. Displays can be used to communicate to others what the class is doing. This can include other students from different classes, other teachers, official school visitors, parents and members of the community. 1.3 Describe how displays are used in the learning process. Displays can be simply decorative. They can make the classroom brighter, and a more interesting and stimulating place. This, in itself, can have a direct impact on pupil motivation and therefore on pupil learning. Display materials can include direct teaching aids such as anatomical models or number lines. They can use useful reference material to support pupil learning or information that is important for students to memorise such as number tables, formula’s, spellings and other important factual information. Display materials can include supplementary teaching aids that simply enrich or reinforce what is being taught, helping to bring a subject ‘to life’. If a foreign country was being studied as part of ‘geography’, a display might include pictures of people and their costumes, famous landmarks, and so on. Displays can be used to ‘set the scene’ for a new teaching topic. They can form the central base of a piece of class work or a topic; they can be a means of recording work that has been done. For example, the title of a display might be ‘What we did in Science. Displays can be part of some on-going work such as an aquarium with tadpoles may be studied and their growth monitored and recorded on graphs to form part of the display. A nature table is another example of a display to create interest. Displays can be used to promote class management. They can include lists of routines, responsibilities, tasks and rules. They can include directions, labels and instructions. They can be used to form part of record keeping. They can be used to record pupil and class progress or topics covered. Student awards, such as ‘star of the day’ and house points can be displayed 1.4 Describe the requirements and procedures for carrying out a risk assessment for displays. There are no procedures printed out in the school policy for risk assessments. They are things you should watch out for especially when working at any height. Staff are instructed not to climb on chairs, tables or other furniture to access display boards. Consider the weight, shape or size of the display when working from a step ladder. Areas where ladders or other access equipment is to be clearly defined by use of signs and barriers if necessary. We have kick step style stools in school. Make sure equipment use is safe. We are encouraged to wear appropriate footwear, on or low healed with non-slip soles. Prepare displays as far as possible before putting them up. Do not work above pupils. Try and work with someone else if possible. Use a staple remover and not scissors or a knife. Ensure you clear up completely when you have finished.

The Source of Laws The legislative branch is one of three branches of the U.S. government- the executive and judicial are the other two- and it is the one charged with creating the laws that hold our society together. Article I of the Constitution established Congress, the collective legislative body made up of the Senate and the House. The primary function of these two bodies is to write, debate and pass bills and to send them on to the president for his approval or veto. If the president gives his approval to a bill, it immediately becomes law. However, if the president vetoes the bill, Congress is not without recourse. With a two-thirds majority in both houses, Congress may override the presidential veto. Congress may also rewrite a bill in order to win presidential approval; vetoed legislation is sent back to the chamber where it originated for reworking. Conversely, if a president receives a bill and does nothing within 10 days while Congress is in session, the bill automatically becomes law. Investigative Duties Congress can also investigate pressing national issues and it is charged with supervising and providing a balance to  the presidential and judicial branches as well. It has the authority to declare war; in addition, it has the power to coin money and is charged with regulating interstate and foreign commerce and trade. Congress also is responsible for maintaining the military, though the president serves as its commander in chief. Why Two Houses of Congress? In order to balance the concerns of smaller but more populated states against those of larger but more sparsely populated ones, the framers of the Constitution formed two disparate chambers.   The House of Representatives The House of Representatives is made up of 435 elected members, divided among the 50 states in proportion to their total population according to the system of apportionment based on the latest U.S. Census. The House also has 6 non-voting members, or â€Å"delegates,† representing the District of Columbia, the Commonwealth of Puerto Rico, and four other territories of the United States. The Speaker of the House, elected by the members, presides over meetings of the House and is third in the line of presidential succession. Members of the House, referred to a U.S. Representatives, are elected for 2-year terms, must be at least 25 years old, U.S. citizens for at least 7 years, and residents of the state from which they are elected to represent. The Senate The Senate is made up of 100 Senators, two  from each state. Before the ratification of the 17th Amendment in 1913, the Senators were chosen by the state legislatures, rather than the people. Today, Senators are elected to by the people of each state to 6-year terms. The terms of the Senators are staggered so that about one-third of the Senators must run for reelection every two years. Senators must be 30 years old, U.S. citizens for at least nine years, and residents of the state they represent. The Vice President of the United States presides over the Senate and has the right to vote on bills in the event of a tie.    Unique Duties and Powers Each house has some specific duties as well. The House can initiate laws that require people to pay taxes and can decide whether public officials should be tried if accused of a crime. Representatives are elected to two-year terms. The Senate can confirm or reject any treaties the president establishes with other nations and is also responsible for confirming presidential appointments of Cabinet members, federal judges, and foreign ambassadors. The Senate also tries any federal official accused of a crime after the House votes to impeach that official.  The House also has the power  elect the president in the case of an electoral college tie. According to the results from the survey, 68% of the family members have their own cars, 22% own two cars and 10% have three cars. Majority of people start to drive from the age of between 17 and 20 years. This is represented by the 65% of the result while 30% start to drive from the age of 13 and 1 6 years. The least number which is represented by 5% say they started to drive from between 21 to 25 years. Petroleum usage per week by each family was between 30 and 40 litters.

In consideration of the whole Kenyan population, and in regard to the diversity of the Kenyan communities, some of which consider alcoholism as a taboo, then this sample is not representative of the total population, and thus the findings may not be reliable to give the actual situation Design, Procedure, Instrumentation The study has effectively referred to previous studies undertaken in this field. A pilot study was also undertaken in 2008 (Kalekye, 2010). The study also analyzed references, by undertaking a literature review, such as reviewing the UNE SCO report of 2009 and the NACADA of 2010. Such evaluation was the basis of formation of the research hypothesis, which postulated that, there is a high rate of parental alcoholism and alcohol abuse in central Kenya region, more than in any other part of the country (Kalekye, 2010). Another hypothesis was that the children and spouses of alcoholics are more likely to be involved in alcohol and other drugs abuse (Kalekye, 2010). The study has stated its problem, objectives, and hypothesis in a clear and understandable manner. Both Quantitative and qualitative methodologies were applied under the study. Questionnaires and interview guide were applied as the data collection instruments, which were more appropriate for the study. Alienation Essay Metamorphosis is a change in physical form or structure. In The Metamorphosis, there is a literal change in the protagonist, Gregor Samsas, physical form from a man to an insect. This metamorphosis brings to light one of the major themes in the novel; the theme of alienation. Todays society demands conformity to its norms and any individual who refuses to accept these faces alienation. Such is the fate of Gregor in the story. Before Gregors metamorphosis, he is alienated from his job, humanity, his family, and even his body. The metamorphosis, however, takes the alienation to a different plane. In the story, Gregors job precipitates his alienation from society, his family, and himself. Gregors initial alienation is from his physical body and as the story progresses we find that Gregors life as an insect is not much different from his life as a human. From the first few paragraphs we get the impression that Gregors metamorphosis has only transformed him from one body to a less convenient one. He does not seem frazzled by his transformation, but explores his new body and tries to work with it. He observes his numerous legs, which were pitifully thin compared to the rest of his bulk (Kafka, 494), he feels a dull ache he had never experienced before (495), and he discovers a place on his body that he cannot itch. Gregor does not seem to have any emotional change due to this transformation. This is evident when he wakes up after his transformation and is annoyed that he cannot go to sleep because he cannot turn onto his right side. He also thinks about how he can no longer attend work.

Miss Maudie & Aunt Alex Essay -- English Literature Essays

Miss Maudie & Aunt Alex The Maycomb ladies provide an excellent example of racial prejudice, and a failure to see what it is like in someone else’s skin. They believe they are doing well by making money for missions, failing to see the hardship on their own doorsteps. Aunt Alexandra is very important to the novel, ‘To Kill a Mockingbird,’ as she is a representative of these viewpoints, disapproving of Calpurnia and disassociating herself from the black community entirely. Miss Maudie however is the counterpoint to Aunt Alexandra. Maudie offers Scout a female role model, whereas Aunt Alexandra tries to make Scout more ladylike, to fit in with her position in life. Aunt Alexandra plays the greatest role in reinforcing class distinctions within the Finch family. As she believes that because the Finch family comes from a long line of landowners, who have been in the county for generations, they deserve greater respect than other people do and therefore must behave according to their status. However her prejudice alienates her from the tolerant Finches, but she fits in well with the rest of Maycomb. Aunt Alexandra has strict and traditional ideas of how society works and the role for a Southern woman within it, which she tries to enforce upon Scout at the beginning to this novel. ‘When I said I could do nothing in a dress, she said I wasn’t supposed to be doing things that required pants.’ Scout immediately takes a dislike to Aunt Alexandra when she criticises her about her overalls. Aunt Alexandra fits in well with the neighbours in Maycomb, but not with the children, as she demands different standards of behaviour from what they are used to. Aunt Alexandra does create an impact during her stay when trying to influence the children during their crucial years of growing up. Atticus is worried that he is not doing his best for his children and is torn between being courteous to his sister and raising Jem and Scout as he sees fit. ‘Your aunt has asked me to try and impress upon you and Jean Louise that you are not from run-of-the-mill people,’ ‘She asked me to tell you†¦.’ Atticus doesn’t really want to do this but realises it’s important to his sister, Jem and Scout can sense this as he keeps saying ‘She asked me to tell you†¦Ã¢â‚¬â„¢ Aunt Alexandra plays a major role in Jem and Scout’s understanding of Atticus’s teachings on racial discrimination and prejudice. S... ... in the last few chapters when Jem and Scout are attacked. Aunt Alexandra redeems herself and realises the importance of the children’s well being and not their status, she becomes a changed women in both the reader’s and Scout’s eyes. ‘Are you all right, darling?’ she asked over and over as she worked me free. The reader also sees a definite change to Auntie when she hands Scout her overalls, ‘the garments she most despised.’ She blames herself for the attack and shows care and tenderness in the final crisis. Both Miss Maudie and Aunt Alexandra are important role models to Scout and Jem at the end of this novel. Especially Aunt Alexandra as she shows the children that there is hope in Maycomb for people to alter their ways and views like she’s started to achieve in the last few chapters to this book. Jem and Scout don’t have a mother figure in their lives but Miss Maudie acts as a feminine role model, helping Atticus to guide them towards the right understanding of life. From this analysis of the two characters Miss Maudie and Aunt Alexandra, it is very clear that they both care very much for the welfare of the children although they go about showing it in very different ways.

French fries, hash browns, a loaded baked potato from Wendy’s maybe. Or what about the term â€Å"couch potato? † This is the only form of potato that is on my list that is not good. Being a couch potato, or living a sedentary lifestyle, is not a healthy choice. Sedentary lifestyle is the term used to describe a lifestyle with little to no physical activity.The activities of a person living a sedentary lifestyle include reading, sitting, watching television, being on the computer, and playing video games for much of, if not, the entire day. The questions at hand is what are the reasons behind living a sedentary lifestyle, what health issues can come from it, and why this lifestyle is not healthy? The lack of physical activity is believed to be a factor of obesity; this can lead to bigger health issu es such as Type 2 diabetes. This lifestyle has also been associated with accelerated aging process and premature death.With other factors such as advanced technology and pure laziness, the sedentary lifestyle is climbing the charts to becoming the leading cause of death in the U. S. These effects of living a sedentary lifestyle are reasons you should get out and get active. Here is a simple math problem: unhealthy eating + no physical activity= a greater chance of obesity. Obesity is a major factor in developing Type 2 diabetes. Obesity is the medical term used to describe a person who has excessive body fat. It can be caused by unhealthy eating mixed with no physical activity.In some people, it is hereditary and others accumulate the excess body fat by living a sedentary lifestyle. It is not healthy to live such a lifestyle. Some of the blame goes to the person living the lifestyle but one could argue that technological advances also play a part in choosing to be a â€Å"couch pot ato. † Nowadays you have the opportunity to work from home, in front of a computer or laptop. Video game creators try to mask their involvement with exercise games such as Zumba and WiiFit but that does not always work. It is ok to be lazy from time to time and have time to rest but that is only if you are up and out and being active.To prevent obesity and possibly Type 2 diabetes, exercise. The exercise does not have to be strenuous but just enough to get you up and moving. Try walking around the park or neighborhood or be active with your kids. Just by exercising 30 minutes a day for at least 5 days out of the week you can prevent the health issues. Have you ever felt older than you really are? Bones cracking, laziness, and fatigue? Well where do your symptoms come from, excessive labor or hard core working out or are you just sitting down not doing anything while your body slowly deteriorates?People who live a sedentary lifestyle accelerate their aging process by living thi s lifestyle which can cause premature death. Being inactive influences and speeds up the aging process. It is said that individuals who are physically active during their leisure time appear to be biologically younger than those who live a sedentary lifestyle. By being inactive, muscle tissues are lost and muscle atrophy, which is the shrinking and weakening of the muscles, sends the body spiraling downwards. This includes all of the body’s systems and one becomes more prone to disease and physical injury.The function of the body is something like a dependency system. Physical strength and fitness is correlated with a strong immune system function, which is the bodies armor and defense system that protects us from disease and illness. It is sort of like parent and child. Once a baby is born, it cannot fend for itself so it depends on its parent to provide what it needs and protect it from any foul harm or danger. If the parent does not do what he or she is suppose to do for t he baby and not protect it, the baby will ultimately be taken from the parent whether by law or nature.It is the same thing with a person and their body. If the body is not taken care of, its chances of becoming ill is greater than the body of a person who is physically active. A reduction in strength and general weakness weakens the efficiency of the immune system increasing the risk of health issues accelerated aging process. No one wants to look or feel older than they really are. Do not just sit around and wait for somebody to do it for you. No one can do it but you. The first law of self-preservation is self-motivation.Think about it like this: the illness and health issues are not going to keep putting off hoping you will stop living a sedentary lifestyle, so why should you put off doing something active. Put the video gaming, television, and computer time to a minimum and use that time to get healthy, get in shape, and fight off those diseases. Physical activity is said to ma ke you feel young and also look the part. So why not get that couch potato up and start cooking and aiming towards living a healthy long life versus a unhealthy and sick life. Get up, get out, and get active!

These could include unfair dismissal, discrimination and redundancy payments. An employment tribunal is similar to a court but it is not as formal and it must act independently. These are commonly open to the public. Employment tribunals are independent judicial bodies who help determine disputes between employees and employers about their employment rights.The tribunal I chose to view and write this report on is an employment tribunal, that involved the claimant putting forward a case of unfair dismissal and breach of contract that was based on the fact that she felt she was unfairly dismissed while carrying out her duties that were set to her by her employer (Dr Monoghon). * Less formal than other court proceedings. * Lower costs. * Benefit of tribunal is they can c hoose to represent themselves. * Lay members specialise in their area of expertise regarding the case.Below are details of the claimant, defendant, time, date and venue. The Case Unfair Dismissal and breach of contract Venue: Croydon Tribunals Date: 13th November 2012 Time: 10:00am – 16:00pm Defendant: Dr Hester Monoghan Claimant: Ms Davidson Evidence: 8 minutes Audio recording After Ms Davidson was dismissed from her job, she later received a call from the nanny agency that she was working for, stating that they had been informed by the police that of an allegation of child abuse by herself on the children.She was then refused to be represented by the agency as they did not want to put forward her name as it would reflect badly on the agency as she had a case on going against her. This prevented her from finding work and therefore was out of work for a period of five months. Ms Davidson opened this case up against the defendant as she feels she unfairly dismissed and had a b ad reputation in regards to her occupation. She therefore wanted to be reimbursed for the loss of the work she missed out on and also wanted to clear her name regarding this issue.Proceedings Upon entering the tribunal room, the judge was seated front centred facing both parties involved in the case, the parties involved were Miss Davidson the claimant, her representative Peter Mathews, seated next to her and parallel to her on the left hand side were the respondents Dr Monoghan and Mr Monoghan. Once entered the judge introduced her and then allowed the defendant and claimant a chance to introduce themselves, preceded by giving defendant an opportunity to provide a brief history of the events which had taken place.Dr Monoghan believed that the claimant had not been fulfilling her duties properly and was in breach of the employment contract as it had come to the Monoghans attention that she was using foul words in front of her children, which the children had picked up and started to use whilst in the home environment. Dr and Mr Monoghan did not approve of this and believed that the claimant had been lying about taking her kids to activities and used to say she did in the diary that had been prescribed to the claimant.For this reason she felt she had to take the situation in to her own hand and therefore had her husband put in place voice recording measures in an open plan kitchen/living/dining room. On 8th March 2012 they made an eight hour recording of Ms Davidson’s shift at her house. This was broken in to segments totalling a twenty minute recroding. After listening to the audio recording they felt that they had â€Å"reasonable grounds to believe that Miss Davidson was verbally abusive and showed a lack of empathy and lovingness towards her children.The evidence The judge then gave Dr Monoghan a chance to play the evidence that had been produced but Mr Monoghan then intervened and then asked the judge â€Å"Is it not against privacy right to play a recording in a public tribunal†. The judge then referred to a ruling book and then she made a judgment that it would be allowed as she felt it corresponded to the guidelines of the tribunal proceedings. Mr Monoghan then setup the audio to show the recording that was made on the 8th March 2012 whilst his children were in care of Ms Davidson.I felt this expression was used for the fact that it was a public viewing and Mr Monoghan felt it was a sensitive situation as it involved his children of a minor age which could be seen as a private matter to him and his family as he would not want his kids further involved in this situation. The audio recording was of snippets of dinner time while the children were in care of Ms Davidson. The children were not paying attention to what Ms Davidson was telling them to do and therefore this was frustrating her.Her mannerism towards the children then indicated that she was persistent for the children eating their food also indicating threate ning behaviour indicated the comment by â€Å"if you don’t eat your food the trolls are going get you†. There were words used such as; â€Å"Go away† â€Å"Shut up† â€Å"Can you just eat your food!! † â€Å"Stop it† There was a constant rudeness to the children throughout this recording. The male child was especially picked on by Ms Davidson as she would say to him â€Å"You, stop being bossy to your sister! During the recording there was a clear sharpness to Ms Davidson’s voice towards the children and there was a continuity of abusive behaviour towards the children. Questioning of Dr. Monoghan Once this audio recording was finished the judge then asked the defendant, Dr Monoghan, to come up on the witness stand. Dr Monoghan was then asked to read out the Oath of Truth in court. The judge then began to ask her questions to break it down and try and work out really what happened.Talking about the appraisal meeting in January defenda nt explained that she had raised the fact that the children had been using inappropriate language to her and her husband such has â€Å"shut up† and â€Å"that’s tough†. She then went on to say that she had highlighted this to Ms Davidson and asked her to restrain from using these words in front of them as felt it would have a negative impact on their upbringing. She also asked Ms Davidson to focus on the male child as she felt her relationship with the female child was a good one. To this Ms Davidson replied by saying that the male child was the most difficult child she has ever looked after.To this the defendant replied that this meeting had been set up simply to raise their concerns but were given no reassurance by Ms Davidson stating that these problems would be sorted. They informed her of the fact that they had a recording and asked her if she would like to hear it but Ms Davidson said she could not do this as she had a job interview to go to as she was go ing to become redundant within the next month and Mr Monoghan had been made redundant from his job and was therefore going to take control of the child care himself. Dr.Monoghan then stated they both left the room and decided between themselves that they were not happy for the claimant to continue her job and therefore dismissed her there and then. Questioning of Mr Monoghan Mr Monoghan stated that he raised concerns and for this reason he was not happy for Miss Davidson to continue looking after his children as he was concerned about the safety of his children. He then stated that he offered to play the recording to Ms Davidson but she refused as she had an interview to attend as she was coming to the end of a contract.This was due to Mr Monoghan becoming redundant from his job and therefore taking control of his children’s wellbeing. Questioning of Ms Davidson Ms Davidson confirmed that the transcript of the meeting was correct. She then went on to say that she felt that sh e was not prepared for the meeting and felt as if she had the right to have an independent witness with her. She then went on to say that she had only said â€Å"Shut up† to the children once and it was unfortunate that she had been caught out on that one instance.She did admit to wrongfully doing by using this phrase towards the children. She was angered with the fact that she was told it was a reference and holiday pay meeting but turned out to be her last day of work. The final verdict The judge felt that as Ms Davidson had been out of work for three months due to the allegations that were made to the police that she should be compensated three months wages. The judge then ordered the defendants to pay Ms Davidson for the two weeks’ notice that she should have had.She dismissed any allegations of MS Davidson physically abusing the children as there was no evidence found and advised the defendants to go through the police if they still felt this was a serious issue a nd also added that no further action would be taken within the tribunal system. Achievement of tribunal proceedings Speed Although the defendant arrived one hour late it still allowed the case to be completed within five hours.From the case I visited I soon realised there was a very productive speed throughout. The case I visited was scheduled for 1 day but was wrapped up within 5 hours and that included a 1 hour lunch, evidence, questioning and the judgment to take place. . There was not much waiting around and the whole case was to the point as through Expertise The judge who was appointed to the case for unfair dismissal was a specialist in this area she specialised in.Off the record the judge mentioned to us that this particular case was a difficult one as it involved one employee and one employer which meant she was dealing with a delicate situation. This was due to it involving children of a minor age and there had clearly been strong relationship between the family and Ms Dav idson as it was previously stated in the appraisal meeting which clearly documented Ms Davidson as having a â€Å"loving and caring relationship† with her children.The judge began by introducing herself and unfortunately she did not have anyone else along with her judging the case so. There was an instance when Mr Monoghan raised an issue of the audio recording being heard while we were present as it children of a minor age talking on it throughout and after consulting a book for a few minutes she then came to a decision that it would not be a problem for this to be played out load while the public was present. Fairness From what I witnessed at the tribunal case I felt that Dr.Monoghan and Mr Monoghan were unfairly judged by the judge as by the evidence that was heard it was clear to see that Miss Davidson was clearly not exercising her job efficiently enough as she was clearly heard using foul language in front of the children and I do believe she should of controlled her temper as this is what she was trained to do. I felt she Miss Davidson won the case based technicality as she was able to say she wasn’t directing her language towards the children and as of this was able to bypass the system and win the case.The judge should have shown more compassion towards Dr. Monoghan and Mr Monoghan as it was a case that applied to their children and therefor was a sensitive on e for them as it could affect the children on the long term. Precedents set by tribunals The lower tribunals are not there to set binding precedents for any other court or even themselves. They are bound by the decisions of superior courts and appellate tribunals.Appellate and Employment appeal tribunals are bound by the decisions that are made by the Supreme Court but they would usually be required to being bound to the decisions that they made themselves (English legal systems, Richard Ward and Amanda Akhtar 11th edition). In regards to employment appeal tribunals, matters of law are binding on decisions of appeals and the House of Lords, although decisions of the high court in England and wales would usually have a great persuasiveness and the ribunals would similarly go with the principles that can be found in those decisions. There are certain precedents rules and guidelines that have been set out by previous legal cases and these have to be followed by tribunals. This allows t here to be more of efficiency throughout the case as the defendants can refer back to the case that is in conjunction with the case however within the judicial system of a tribunal court there is a leniency and flexibility based on the case this was as well as the evidence and information provided by both parties.Taking this information into consideration the laments will then deliberate and make their decisions. Similar cases may have different outcomes which will not be based on the same precedents. Tribunals such as an employment based cases are required to follow certain procedures and take in to consideration such as reasons for dismissal with the notice given for dismissal and other externalities that are relevant to the case for dismissal. Main issueThe main issue with tribunals setting binding precedents for other courts and themselves is that in tribunals there is a sense of flexibility in their operations and the judges and the courts use their interpretation of the situat ion to make a judgement and it would be optimistic to think that the doctrine of the binding precedents achieves the certainty and flexibility. Conclusion The judgement of the case went in favour of the claimant in the tribunal.I feel this is an unfair judgement as the parents had intrusted the claimant in taking care of their children in an appropriate manner but it was clear throughout the audio that was played that was not applied by the claimant and there was a constant rudeness and aggressiveness towards the children. I feel that as the claimant would have been a trained with the necessary skills to look after the children she should have still been able to detach her emotions from her actual duties towards the children as she is trained in this profession.
